Human Rights Issues

The implementation of the Human Rights Act 1998 in October 2000 has facilitated the incorporation into UK law of rights and freedoms guaranteed by the European Convention on Human Rights. This allows the British Domestic Courts to consider Human Rights representations.

In practical effect this act has the potential to affect many aspects of English Law for example Criminal Law, Family Law, Immigration Law to Public order issues.

We can provide legal advise on a wide range of Human Rights issues affecting an individuals rights and freedoms. We have achieved considerable success with Human Rights representations lodged at asylum appeals. Numerous asylum appeals have succeeded by way of the Human Rights articles raised. We have recently achieved a successful outcome under article 8 ,the right to private and family life and article 3 , the protection of an individuals rights against inhumane treatment and/or torture.

If you have received a letter of refusal from the Home Office prior to October 2000 and your asylum appeal has been refused, we are in a position to provide legal advise in forwarding an appeal under the Human Rights Act.

We are also able to provide Human Rights legal advise with regards to conditions of detention when detainees are kept in conditions condemned by the Inspectors of Prisons, representations where freedom of speech or freedom of sexuality have been denied.

Legal advice will be provided on a private fee paying basis (details of fees provided upon request).

Advise may be provided in conjunction with existing matters for which legal aid has already been provided.
