What are pre and postnuptial agreements?
A prenuptial agreement is a formal written agreement made by a couple before they get married or enter into a civil partnership. It sets out how the couple’s assets will be shared if their relationship should come to an end. While many people associate such agreements with celebrities or high net worth individuals, they are increasingly used by couples regardless of their wealth to provide clarity and certainty for the future.
Postnuptial agreements are basically the same as prenuptial agreements, the difference being that they are made after the couple has entered into a marriage or civil partnership.
Both prenuptial and postnuptial agreements are tailor made to each client. They can cover all assets or just key elements (for example pre-marital assets).
A pre or postnuptial agreement will be legally binding in England & Wales if it is correctly drawn up and certain conditions are met. Our solicitors can provide clear, jargon-free advice in this area of law which has become increasingly popular in recent years.
