Driving Without Due Care and Attention
This offence relates to a specific occasion during which it is suggested that the standard of driving fell below that of a reasonable and prudent driver. Examples of this types of offences can be poor lane discipline, swerving while changing radio station, eating and drinking behind the wheel.
This allegation can be defended by showing that in the specific circumstances of the driver, any reasonable and prudent driver would have reacted/driven in the same way. If convicted, in many circumstances, a fixed penalty of 3 points and £100 fixed fine is given.
However, some careless driving /motoring offences are more serious than other, in which case the fine can be unlimited with 3-9 points and even a discretionary ban. If the driver is involved in a fatal crash and is found to be responsible for a momentary lack of concentration that led to the incident, the driver can be prosecuted for causing death by careless driving.
