Appealing against a conviction can be a difficult and complex process but a conviction can have life changing consequences. If your solicitors advised that you have no grounds to appeal, you may want to seek a second opinion from a new professional legal advisor,  especially  iyou feel your case was not defended as robustly as it could have been

The rules around appeals depend on which court the case was heard in. There is an automatic right to appeal a conviction after trial in a Magistrates’ Court.  If person is convicted after trial in a Crown Court, permission to appeal needs to be sought from the Court of Appeal.

If your case  was heard in the Magistrates Court, then, the appeal should be lodged within 21 days of the sentence date.  The appeal allows a rehearing of the case at the Crown Court by a judge and two magistrates. It is important to note that an unsuccessful appeal may result in additional costs awarded againstyou and / or possibly an increase in the sentence.

A conviction in the Crown Court can only be appealed if there was a mistake in the trial processor the sentence is manifestly excessive. It cannot be appealed just because you do not agree with it.  Appeals against conviction from the Crown Court should be lodged within 28 days of conviction. If an appeal is made but is unsuccessful you may be liable for prosecution costs. If the appeal is deemed to be without merit then all or some of the time served on remand or to the date of appeal may not count towards the sentence.
