Lasting Powers of Attorney (LPAs)

A Lasting Power of Attorney (LPA) is a document whereby a person (the Donor) gives another person or a number of people (the Attorney(s)) power to act on the Donor’s behalf with regard to his/her property & financial affairs, his/her personal health & welfare, or both. Due to the type of Power of Attorney this is, it requires registration at the Office of the Public Guardian and is only valid following registration.

Why make an LPA?

An LPA is a legal document which enables a person/people appointed (the Attorney(s)) to act as if they were you (the Donor). Just with any legal document, the rules governing LPAs are strict and must be drawn up in a prescribed format. Furthermore, we as Solicitors need to be satisfied that you are making the LPA of your own free will, that you understand the purpose of an LPA and the powers which are being conferred upon the Attorney(s).

Types of LPA's

There are two types of LPAs:

A Property and Financial Affairs LPA allows the Attorney to make decisions which relate to the Donor’s property and financial affairs, so this could be paying bills, collecting benefits or other income, or even selling the Donor’s house (subject to conditions). 

A Health and Welfare Decisions LPA allows your Attorney to make decisions on a Donor’s behalf about his/her personal welfare. This could include making decisions about where the Donor resides, giving or refusing consent to medical treatment, together with more day to day decisions relating to diet, daily routine or dress. Decisions about life-sustaining treatment must be included in the form i.e. an organ transplant, major operation or cancer treatment, but it could also include a course of medication. In order to limit the powers given to the Attorney(s), a Donor can include restrictions and/or conditions on their LPAs to ensure the Attorney(s) does or does not do something in particular or act in a certain way.

  • Can also act as the Certificate Provider and we will ensure all Attorneys appointed complete the documents in the necessary format. Furthermore, we complete the Registration of the LPAs with the Office of the Public Guardian to ensure that the documents are in place for when they are required.
