Enduring Power of Attorney
An Enduring Power of Attorney (EPA) is a document whereby a person (the Donor) gives another person or a number of people (the Attorney(s)) power to act on the Donor’s behalf with regard to his/her property & financial affairs. You can use an EPA at any time if it is legal and validly drawn up, and provided the Donor has given you permission, however you must Register the EPA once the Donor starts to lose or has lost his/her Mental Capacity, meaning they are unable to make a decision at that time because of a mental impairment.

Why register an EPA?
An EPA is a legal document which enables a person/people appointed (the Attorney(s)) to act as if they were you (the Donor). Just with any legal document, the rules governing EPAs are strict and must be drawn up in a prescribed format.
Only if you have drawn up and signed an EPA before 1st October 2007 can it still be used, otherwise anything after this date means the Donor must make a Lasting Power of Attorney (LPA).
An EPA sets out who is responsible for assisting the Donor with decisions of a financial nature such as managing their Bank/Building Society Accounts, helping them pay their Bills or managing their Money. It can also include the buying and/or selling of Property, such as the Donor’s house, or collecting benefits, pensions or any other income the Donor may receive.
It can provide Attorneys with specific instructions and/or guidance which may affect their responsibilities and the way in which they act. Any decisions made on behalf of the Donor by the Attorney(s) must be in the best interest of the Donor.
Once the Donor starts to lose or has lost his/her Mental Capacity, the EPA must be registered in the prescribed format and upon providing the requisite Notice to all of those involved.
